General

You can only purchase goods from our website. Would you like helpful instructions as to how to shop with Stayhard? Please contact our Customer Services for assistance.

- The prices include VAT 25%.
- If you are under 18 years of age, you must have your permission from your parents to order goods from us.

All goods remain the property of Stayhard until full payment has been made to the company. Stayhard reserves the right to cancel any purchase if fraudulent activity is suspected.


Right of withdrawal
No transaction is complete until you have tested and are satisfied with your order and you have a two-week period in order to do so. At Stayhard, we would want our customers to be completely satisfied or receive their money back! As a customer, if you do not wish to accept a new proposed deadline in the event of a delay, you have the right to cancel your order with no cost.

We follow The National Board's recommendations
If you are not satisfied with an item you have ordered, there is a two week right of return period after you receive the goods. Customers can open the package in order to verify the contents. You always have the right to cancel an order if the product is out of stock. The two week right of return period applies to all products except underwear or products that have been used.

As a customer, you are obliged to organize the return of goods if you are dissatisfied in any way. Once we have received the returned item and agreed that it not damaged, we reimburse the cost within 30 days, including any fees.

NOTE! Normally it takes about 2 weeks from when you sent your return to us before you receive any reimbursement. In exceptional cases, it may take up to 30 days (the maximum time as stated by law).

Stayhard is held responsible for any risk of transport of orders to customers. The customer is responsible for the return of orders back to us. Stayhard reserves the right to change incorrect prices of our products.

 


Delivery


Normally, the delivery time of goods is 3-7 working days. Should your order not be sent in time due to errors, we will contact you and you have the right to cancel your order. Stayhard will always send an order confirmation email to the address which you provided to us before we sent the goods to you.

Our packages are sent by Pan Nordic Logistics.

Transport Damage
If the package (or the contents) is damaged when you receive it, report this immediately to our Customer Services.

Shipping Costs
When purchasing items costing less than 200 EUR, the cost of shipping is 12 EUR. For any orders above 200 EUR, Stayhard offers customers a free shipping service.

The minimum amount per order is 20 EUR.


Exchange and the right of return
You have full return and exchange rights within 14 days from the day you received your order, provided that you have not used the product. You may, of course, try on your product in order to ensure that it suits you! The return and exchange law does not apply to underwear. If you wish to return or exchange an item, you have to pay the return shipping cost.

Once we receive the goods and accept that they are not damaged, we will reimburse the full amount including any fees paid. If you have ordered more products than the one you have returned, we will not reimburse the fees (this is due to the fact that the charges are the same regardless of how many items you order). The product should be returned in the same condition as when you bought it.

However, if there is a complaint due to damaged or wrongly delivered items, we will refund the return shipping cost, as well as the total cost of items which remain in storage. NOTE! If we cannot send you a replacement product, or you did not originally order more than one product, we will repay all of your costs. All returned goods must be packaged in a plastic bag or cardboard box. Do not return items by simply placing an address label onto the original packaging. If the item becomes damaged we will not repay the full amount of the purchase price.

For exchanges, returns or complaints, Stayhard adheres to the recommendations of the Swedish Consumer Agency's rules for e-commerce.

 


Security

With regards to registration and ordering, you agree by law that we can store and use your personal information in our business database in order to meet our commitment to you. Stayhard protects your personal data under the Data Protection Act. You always have the right to see your personal data that is registered with us. If it is in any way incorrect or incomplete, you have the right to alter the data as you wish. Stayhard uses an encrypted data transmission system. Payments and personal details are viewed via secure pages (SSL) on the internet.


Range Changes
Stayhard reserves the right to remove any items from an order before a purchase has been finalized. We reserve the right that products can be out of stock. Stayhard reserve the right for any typographical errors which may occur in the text on our website. We give no guarantee that all of the images accurately to 100% reflect the true appearance of our products. Also, Stayhard reserves the right to adjust any prices and any other errors.

Force majeure
In the event of war, warlike events, civil war, revolution, insurrection, governmental action, strike, lockout, blockade, natural disaster or similar event, Stayhard will be able to apply force majeure. This means that our agreement with our customers need not be fully achieved. If this occurs, we will inform you regarding the situation. In the event of any dispute, we follow the decision of the General Complaints Board.

Online Payment
You can pay with Visa, American Express or Mastercard. Select the type of card you wish to pay with and follow the instructions. The goods are sent to you immediately after payment has been made.

 

Personal Data

Stayhard is responsible for processing the personal data you provide us with, such as your name, address, personal ID number, telephone and mobile number, and e-mail address. We will process your personal data in order to be able to manage your purchases, for marketing purposes via, for instance, electronic communication services, and to develop our products and services. Your personal data may also be shared with and processed by our parent company Ellos Group AB and its subsidiaries in the Ellos Group, as well as by our partners for the aforementioned purposes. Your personal data may be shared with companies both within and outside Europe.

Your personal data may therefore be forwarded to and stored on Google’s servers, which are located throughout the world. Your personal data may thus be managed on a server that is located in a country other than where you live. Google may also transfer your personal data to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other personal data that may be held by Google.

The data we analyse may include, for example, your IP address, your most recent purchases, payment methods, and any other information that you provide us with as a customer. We may store your personal data for up to three years after your customer relationship with us has ended, for marketing purposes as detailed above. We consider you a customer during the period when you are paying off your purchases or using any of the services provided on our site. We also consider you a customer during the guarantee period for a product/products you have purchased from us.

By purchasing a product/products from our range and/or applying for credit, you consent to your personal data being processed as detailed above. You can withdraw all or part of your consent by writing to us at the address below.

Personal data is provided voluntarily. If you do not want your personal data to be used for direct marketing, please let us know by either calling us on telephone number +46 (0)33-7206162, e-mailing us at customerservice@stayhard.eu or writing to Stayhard AB, Box 961, SE-501 10 Borås, Sweden. As a customer, you are entitled to request, by writing to us at the aforementioned address, information about the personal data we have collected about you and how this data is used. You are also entitled to request that we correct or erase any incorrect information about you.

 

Disputes

If a dispute cannot be resolved you can submit your complaint to the online complaints platform on the EU Commission’s website: http://ec.europa.eu/odr. In any dispute, Stayhard follows the recommendations of ARN or the respective dispute settlement body found on the EU Commission’s website.
